GENERAL RULES AND REGULATIONS:

All in attendance of the Yard Sale are to abide by all Rules and Regulations contained within this web site.

1. 5 m.p.h speed limit will be strictly enforced on Yard Sale site.
   When leaving, Sellers must drive slowly and cautiously towards the exit, giving pedestrians the right of way and following the designated “exit route.”
2. No loud music or sounds will be allowed unless previously authorized.
3. If any emergency arises during operating hours and Seller must leave, immediately notify Malibu Yard Sale staff members to assist in leaving the site safely.
4. No refunds – all sales are final.
5. Solicitation of any kind is prohibited.
6. If an individual is caught disrupting operations in any way, they will be removed.
7. No skateboarding, bicycle riding, scooters, rollerblades, or similar activity will be allowed during operating hours (Sellers that sell this type of merchandise must inform the Shoppers of the policy at the time of sale).
8. No profanity, harassment, or violent actions of any kind directed toward Malibu Yard Sale staff members, Shoppers, Vendors or Sellers will be allowed.

Prohibited Items:

All in attendance at this event specifically agree not to bring on the property of Malibu Storage any of the following prohibited items:

1. All forms of alcoholic beverages or products containing alcohol or drugs of any kind.
2. Food items (unless otherwise approved for sale).
3. Pornographic items of any nature. This includes adult magazines, videos or any type of sex products that the Malibu Storage deems offensive or sexual in nature.
4. Pets or animals of any kind.
5. Guns, weapons, ammunition or any product resembling guns or weapons.
6. Any hazardous or dangerous products.

GENERAL RULES AND REGULATIONS

All Sellers registered to attend this Community Yard Sale agree to personally occupy and attend the assigned space during operating hours and to abide by all guidelines and Rules and Regulations contained within this web site.

1. 5 m.p.h speed limit will be strictly enforced on yard sale site.
   • When leaving, Sellers must drive slowly and cautiously towards the exit, giving pedestrians the right of way and following the designated “exit route.”
2. All Sellers must park off-site during the hours of yard sale operation.
   • Vehicles may enter the premises before and after the event to pack and unpack materials.
3. No parking will be allowed in a designated “selling space” unless previously authorized.
4. All merchandise must be within the allotted selling space for each Seller prior to the start of the community yard sale.
5. No loud music or sounds will be allowed unless previously authorized.
6. Each Seller is responsible for the actions of their “employees” or workers on-site.
7. Sellers may not relocate their space without prior approval from the Malibu staff.
8. It is the responsibility of each Seller to ensure that all temporary structures or selling material is secured in such a way as to avoid injury to persons or property.
9. Trash bins located on the premises are for customer’s use only. All trash generated by Seller must be disposed of outside the yard sale premises.
10. If any emergency arises during operating hours and Seller must leave, immediately notify Malibu Yard Sale staff members to assist in leaving the site safely.
11. Ownership may not be assigned to another individual unless previously authorized, and any transferee must provide all required documentation.
    • Spaces may be shared if the appropriate documentation is provided
    • Space may not be sold or transferred
    • In the event that management approves the transfer of a space, the transferee agrees to act as an agent of the transferor of the space. No refunds if main office is not notified within at least 48 hours prior to event.

16. Malibu Storage reserves the right to approve or disapprove any merchandise sold, or to deny any request for a reservation of a selling space at the Malibu Community Yard Sale.

Reserved spaces at the Malibu Community Yard Sale are for the sale of approved merchandise only. We reserve the right to prohibit the sale of any item at any time. By paying the applicable fees for reserving a selling space, Seller is agreeing to comply with all the Guidelines, Rules and Regulations set forth for this event and specifically agrees not to sell, display, or advertise any of the following prohibited items:

1. All forms of alcoholic beverages or products containing alcohol or drugs of any kind.
2. Food items (unless otherwise approved for sale).
3. Pornographic items of any nature. This includes adult magazines, videos or any type of sex products that the Malibu Storage deems offensive or sexual in nature.
4. Tobacco, water pipes, or any type of smoking paraphernalia, drug, or narcotic.
5. Pets or animals or any kind.
6. Guns, weapons, ammunition or any product resembling guns or weapons.
7. Any item or service infringing on any patent, trademark, or copyright including any illegal merchandise of any kind.
8. Any hazardous or dangerous products.
